PASSENGER / SPECTATOR WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING
By signing this document, you may be waiving certain legal rights, including the right to sue.

2. ACKNOWLEDGEMENT OF RISK
 
I understand that participation as a passenger or spectator in Bahamas Powerboat Club (“BPC”) events—including poker runs, boating excursions, raft-ups, and social events (“Events”)—involves significant risks.
 
These risks include, but are not limited to:
•High-speed boating and open ocean conditions
•Collision, capsizing, or vessel accidents
•Rough seas, wakes, and changing weather
•Injury caused by vessel operation or other participants
•Mechanical failure or lack of safety equipment
•Drowning, falling overboard, or serious injury
 
I acknowledge that these risks may result in serious injury, permanent disability, or death, and I voluntarily accept all such risks.
3. THIRD-PARTY VESSEL ACKNOWLEDGEMENT
 
I understand and agree that:
•The vessel I am boarding is privately owned and operated by a third party
•The vessel owner/captain is not an employee, agent, or representative of Bahamas Powerboat Club
•Bahamas Powerboat Club does not own, operate, inspect, or control any vessel
 
Any claims for injury must be directed to the vessel owner or operator—not Bahamas Powerboat Club  
4. RELEASE OF LIABILITY
 
In consideration for being permitted to participate, I hereby:
•Release, waive, and discharge Bahamas Powerboat Club, its owners, officers, staff, affiliates, sponsors, and partners (“Released Parties”)
•From any and all claims, damages, injuries, losses, or death
•Whether caused by negligence or otherwise
 
This includes risks arising from vessel operation, event organization, or actions of third parties  
 
I understand that I am giving up my right to sue the Released Parties.
5. LIMITATION OF LIABILITY
 
I understand and agree that Bahamas Powerboat Club is not responsible for:
•Negligent or reckless operation of vessels
•Captain error, excessive speed, or alcohol impairment
•Mechanical failures or poor maintenance
•Lack of safety equipment or instruction
•Any actions or decisions made by vessel owners or operators  
6. ASSUMPTION OF RESPONSIBILITY
 
I acknowledge that:
•I voluntarily choose to board and participate
•I may refuse to board any vessel if I feel unsafe
•I am responsible for my personal safety at all times
•I will follow all safety instructions provided by the captain
 
I understand that wearing a life jacket is recommended and reduces risk.
7. MEDICAL & FITNESS DECLARATION
 
I confirm that:
•I am physically and mentally fit to participate
•I have no condition that would increase my risk
•I have adequate insurance or accept responsibility for medical expenses
 
Emergency medical assistance may be delayed or unavailable.
8. INDEMNIFICATION
 
I agree to indemnify, defend, and hold harmless Bahamas Powerboat Club from any claims, damages, or legal expenses arising from:
•My participation in the event
•Any claims brought by me or on my behalf
•Any claims from my family, estate, or representatives  
9. MEDIA RELEASE
 
I grant Bahamas Powerboat Club the right to use my:
•Name, image, voice, and likeness
•Photos and videos from the event
 
For promotional, marketing, and media purposes without compensation.
10. RULES & CONDUCT
 
I agree to:
•Follow all event rules and instructions
•Act responsibly and respectfully
•Avoid unsafe or disruptive behavior
 
Failure to comply may result in removal from the event without refund.

11. GOVERNING LAW

This Agreement shall be governed by the laws of
The Commonwealth of The Bahamas

All disputes shall be resolved exclusively in Bahamian courts.

12. ACKNOWLEDGEMENT
 
I certify that:
•I have read and fully understand this waiver
•I understand I am waiving substantial legal rights
•I sign this voluntarily without coercion

I, the parent/legal guardian, consent to the minor’s participation and agree to all terms of this waiver.
