PARTICIPANT & VESSEL OWNER WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING
By signing this document, you may be waiving certain legal rights, including the right to sue.

2. ACKNOWLEDGEMENT OF RISK

I acknowledge that participation in Bahamas Powerboat Club (“BPC”) events, including but not limited to poker runs, boating excursions, raft-ups, and social gatherings (collectively “Events”), involves inherent risks.

These risks include, but are not limited to:
* High-speed boating and navigation hazards
* Collision with vessels, objects, or land
* Rough seas, wakes, and changing weather conditions
* Equipment failure or mechanical malfunction
* Falling overboard, drowning, or injury
* Injury caused by other participants or third parties
* Delayed or unavailable emergency response

I understand that such risks may result in serious injury, permanent disability, or death. I voluntarily choose to participate despite these risks.

3. ASSUMPTION OF RESPONSIBILITY

I acknowledge and agree that:

* I am solely responsible for my safety and the safety of my passengers/crew at all times
* I am physically and mentally fit to participate
* I am not under the influence of drugs or alcohol that may impair my ability
* I will operate my vessel safely and in accordance with all applicable laws
* I will follow all event guidelines, captain briefings, and safety recommendations

4. CAPTAIN’S CERTIFICATIONS AND REPRESENTATIONS

I hereby certify and represent that:

* I am at least 18 years of age and legally competent to enter into this Agreement
* I possess a valid driver’s license or boater safety certification as required by applicable law
* I am qualified and experienced to operate the vessel under offshore and high-performance conditions
* I understand and accept full responsibility for the operation and control of my vessel at all times

5. VESSEL OWNER / OPERATOR RESPONSIBILITY

If I am operating or providing a vessel for the Event, I certify that:

* I am the legal owner or authorized operator of the vessel
* My vessel is seaworthy, properly maintained, and equipped with required safety equipment
* I hold all required licenses and insurance coverage
* I accept full responsibility for all passengers, crew, and operation of my vessel

I understand that Bahamas Powerboat Club does not inspect vessels or verify operator qualifications and makes no guarantees regarding safety.

6. THIRD-PARTY VESSELS

I understand and agree that:

* All vessels are privately owned and operated
* Vessel owners and captains are independent participants
* Bahamas Powerboat Club does not control, operate, or manage any vessel

Any claims arising from vessel operation must be directed to the vessel owner/operator, not Bahamas Powerboat Club.

7. RELEASE OF LIABILITY

In consideration of being permitted to participate, I hereby:

* Release, waive, and discharge Bahamas Powerboat Club, its owners, officers, employees, affiliates, sponsors, partners, and event organizers from any and all liability
* Agree not to sue for any injury, loss, damage, or death arising from participation
* Accept full responsibility for all risks, known and unknown

This includes claims arising from negligence or otherwise.

8. INDEMNIFICATION

I agree to indemnify and hold harmless Bahamas Powerboat Club from any claims, damages, or expenses (including legal fees) arising from:

* My participation
* My vessel
* My passengers or guests

9. MEDIA RELEASE

I grant Bahamas Powerboat Club the unrestricted right to use:

* My name, image, voice, and likeness
* Photos and videos of my vessel and participation

For marketing, promotional, and media purposes without compensation.

10. MEDICAL CONSENT

I authorize emergency medical treatment if necessary and understand:

* Emergency response may be delayed or unavailable
* I am responsible for all medical expenses

11. RULES & COMPLIANCE

I agree to:

* Follow all Bahamas Powerboat Club rules and event instructions
* Operate responsibly and respectfully
* Comply with all local maritime laws and regulations

Failure to comply may result in removal from the event without refund.

12. JURISDICTION & GOVERNING LAW

This Agreement shall be governed by the laws of The Commonwealth of The Bahamas.

Any disputes shall be resolved exclusively in the courts of The Bahamas.

13. ACKNOWLEDGEMENT

I certify that:
* I have read and fully understand this Waiver
* I understand I am giving up substantial legal rights
* I am signing voluntarily and without coercion

FOR VESSEL OWNERS

I accept full responsibility for all persons on my vessel.
